Terms and Conditions
Welcome to Caked by Ayesha. High quality of service is really important to me so I’ve put together some terms and conditions to assist me in maintaining high standards within my business. These T&C’s are developed so that you as the customer are fully aware of what to expect when purchasing an edible creation from Caked by Ayesha.
By agreeing to a quotation and paying your invoice, or purchasing one of my products online we assume you have read these T&C’s and have agreed to abide by their contents. If you have any questions regarding specific T&C’s it is imperative that you contact me prior to any payments or acceptance of quote.
In these terms and conditions any reference to Ayesha, our, my, myself, me, us, I, we, means Caked by Ayesha as the supplier of goods and/or services. Any reference to you, your, your representative means the customer or purchaser of the goods and/or services provided by Caked by Ayesha.
All products made by and purchased from Caked by Ayesha are subject to the following Terms and Conditions.
ALLERGIES
All products supplied by Caked by Ayesha may contain, or come into contact with, soy, wheat, dairy, nuts, eggs or other allergens.
It is the responsibility of the Customer to inform me prior to the confirmation of their booking of any allergy issues. It is the responsibility of the Customer to inform their guests of all allergy information and accordingly the Supplier will not be held liable for any allergic reaction resulting from consumption of the purchased product.
All products are made to be eaten on the day of the celebration. It is the responsibility of the Customer to provide the planned celebration date prior to ordering.
QUOTATIONS
All Quotations are valid for 7 days from the date of issue. A quotation is not equal to confirmation of the order. If the Customer would like to proceed with the order it is their responsibility to inform me as such so that the order can be progressed and secured by payment of the invoice.
ORDERS
We prefer at least three (3) weeks’ notice for all orders, as we are continually booked in advance. We will however endeavour, where availability permits, to accept short notice cakes.
Any Products ordered based on a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.
PAYMENTS
The option for part-payments (deposit and final payment) is only offered for wedding orders or orders where the total value exceeds $500. For all orders below this value will require to be paid in full at the time of booking (or the date specified on the invoice) in order to secure your chosen date.
For all orders 50% of the total order value is considered to be non-refundable in the case of a cancellation. Please see details on refunds / cancellations / postponements for further details.
For orders eligible for part-payment the final balance will be required a minimum of 2 weeks prior to the event date.
All payments must be made on or before the “Due date” as specified on the invoice. In the case where payment has not been received on or before the due date, with no communication from the customer, the order may be cancelled.
UNFORESEEN CIRCUMSTANCES
In the very unlikely case that I am unable to make your cake due to illness or any other unforeseen circumstance the order may be cancelled and all payments made will be refunded in full. If this does happen Ayesha commits to notifying the customer as early as possible so the customer is able to find an alternative.
In the event that an unforeseen circumstance impacts the ability for your planned event to go ahead it will be the Customers responsibility to contact me with as much notice as possible. I will make accommodations where possible to either reschedule or refund your order in line with the refunds / cancellation / postponements policy below. Any additional considerations will be made at my discretion.
PICKUPS
Full payment must be made before pickup date, and before the Product leaves the premises.
It is the responsibility of the Customer to check the state of the product before leaving the premises. Once the item has left the premises, the Customer is responsible to ensure that products arrives at its destination safely and is stored as per our instructions to achieve best results for taste and quality.
The Customer is liable for any damage, accident, or mishap that may occur once the cake is released from the care and custody of the Supplier’s. The Supplier is not liable for any damage that may occur thereafter.
Collection of orders will take place within a scheduled 30 minute window as agreed by both parties. It is the responsibility of the Customer to inform Ayesha if they are running late or if they will need to reschedule their collection for a later time/date. If collection is not made withing the agreed upon collection window, and no contact is made with Ayesha by the customer, a late fee of $5 will be charged for every 10 minutes past the collection window until collection is made.
If a third party will be collecting the cake on the customer’s behalf, the third party must be organised by the Customer ahead of time and it is the Customers responsibility to notify Ayesha or the arrangement. Ayesha will not be liable for any damages that may occur once the product has left our care and custody.
DELIVERY
Pick-up is preferred with delivery being limited to Ayesha’s availability. If delivery is available and offered it will be charged at my discretion.
Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer to store and care for the cake as per our instructions. If anything is to happen to the cake after this exchange, we are not liable for any damages.
A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the product will be transported back with our premises and it will be the customer’s responsibility to collect the product.
PUBLICATION
We reserve the right to use any image of a Product made by us for publication at a later date.
HIRED EQUIPMENT
Refundable deposits are taken for all equipment. All equipment must be returned on agreed date or extra charges may be levied to cover hire costs. Any damages to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.
REFUNDS/CANCELLATION/POSTPONEMENT POLICY
Postponement
If, for any reason the event is required to be postponed, please contact me immediately. The new date proposed will be subject to availability.
Notifications received 7 or more days prior to the original date will not incur any additional costs and the payment already made can be transferred to the new date, subject to availability.
Notifications received less than 7 days before the original date may incur additional costs. Any additional cost incurred will be at Ayesha’s discretion.
Cancellation/Refunds
If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:
If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, less your initial deposit and the cost of any supplies already purchased for your cake.
If the cancellation is less than seven (7) days prior to your event, there will be absolutely no refunds given.
Refunds will be paid within 28 days of cancellation.
Please note: Any non-refunded balance, less any costs already incurred, may be credited toward future purchases.
ACCEPTANCE OF THESE TERMS AND CONDITION
Payment of your invoice assumes acceptance of the above terms and conditions. If the customer has any queries regarding the terms and conditions it is their responsibility to contact Ayesha prior to paying the invoice and proceeding with their order.
